THE TRUST COMPANY serves as active trustee, assuming discretionary authority and fiduciary responsibility for your plan’s investment management. Further, we certify that we qualify as an investment manager as defined in Section 3(38) of the ERISA. 

As Corporate Trustee we are responsible for the financial integrity of your qualified plan assets.  We serve as custodian for all assets irrespective of the depository and are responsible for properly reporting the value of your plan assets, even those which are not readily marketable such as limited partnerships and closely held securities.  All transaction activity must meet accounting and ERISA standards; we also file a return with the IRS for any unrelated business taxable income. We retain a recognized accounting firm (Clifton Gunderson) to issue an unqualified opinion on our operating practices and to prepare a SAS 70 report upon which your internal and external auditors may rely.  We engaged the services of an ERISA specialist about five years ago to act as our ERISA counsel and keep our administrative team abreast of ERISA issues and new legislation.
